Rules: Game of the Day
OFFICIAL RULES
No Purchase Necessary. Open to legal residents of the 50 United States including the District of Columbia who are 18 years of age or older as of the date of entry.
1. PROMOTION PERIOD: The New AOL® Games Site Promotion (the "Promotion") begins at 10:00 a.m. Eastern Time ("ET") on 1/26/2011 and ends at 9:59 a.m. ET on 1/1/2012 (the "Promotion Period"). The Administrator's computer shall be deemed to be the official timekeeping device for this Promotion. The Promotion includes two separate portions, a sweepstakes (the "Sweepstakes") and an instant win game (the "Instant Win") (The Sweepstakes, together with Instant Win, are referred to as the "Promotion").
2. SPONSOR: The Promotion is sponsored by AOL, Inc., 770 Broadway, New York, NY 10003 ("AOL") and Sprint Communications Company L.P., 6200 Sprint Parkway, Overland Park, KS 66251 ("Sprint") (collectively referred to as the "Sponsor"). The Promotion Administrator is Don Jagoda Associates, Inc. ("Administrator"), 100 Marcus Drive, Melville, NY 11747.
3. AGREEMENT TO OFFICIAL RULES: Participation in the Promotion constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
4. ELIGIBILITY: Open to legal residents of the 50 United States including the District of Columbia and who are eighteen (18) years of age or older as of date of entry. Employees of Sponsor and Administrator, their respective brands, affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies ("Promotional Entities") and their immediate family members and/or those living in the same household of each are not eligible to participate or win.
5. HOW TO ENTER THE SWEEPSTAKES: To enter the Sweepstakes, visit http://www.games.com/new-games ("the "Website") during the Promotion Period and register by completing the AOL/AIM screen name registration form, or you may log in if you have already an AOL/AIM screen name. It is free to sign up for an AOL/AIM screen name. Any individual whose AOL/AIM screen name is on suspension at any time during the Promotion Period, as a result of a Terms of Service violation, is not eligible to participate in the Promotion. For each 24-hour period you play the featured "Game of the Day" (whether or not you complete the game), you will receive one (1) Sprint ticket ("Ticket"). Each Ticket will equate to one entry in the Sweepstakes. If you play all of the games featured on the Website for all of the 24-hour periods in any of the months (or partial months, if applicable) included within the Promotion Period, you will receive five (5) bonus Tickets (regardless of whether or not you complete the games). Limit one (1) entry per person per 24-hour period and five (5) additional entries per person, per month. For purposes of this Promotion, a 24-hour period is defined as beginning 10:00 a.m. ET and ending 9:59 a.m. ET the following day. A week is defined as beginning at 10:00 a.m. ET on a Monday and ending at 9:59 a.m. ET on the following Monday, except for the first week of the Promotion in which a week begins on a Wednesday and the last week of the Promotion which ends on Sunday, January 1, 2012. A month is defined as beginning at 10:00 a.m. ET on the first day of each month, and concluding at 9:59 a.m. ET on the first day of the following month during the Promotion Period. All entries received during a given month will be entered into that month's random drawing only. Entries will not be entered into subsequent month's random drawings, if any.
6. HOW TO PLAY THE INSTANT WIN GAME: The Instant Win will be available for a 24-hour period (beginning at 10:00 a.m. ET and ending on the following day at 9:59 a.m. ET) one time per week during the Promotion Period (and will vary each week). To play the Instant Win for the chance to win a daily Instant Win Prize, visit the Website, and if you see that the Instant Win is available, click on the Instant Win banner, complete the online registration form or log-in and play the featured game ("Game") to see if you reveal an instant win message. If you have won an Instant Win Prize ("Instant Winner"), you will be notified on-screen and will receive an email shortly thereafter with details on how and when you can receive your Instant Win Prize (subject to verification). In order for a Game play to be a potential winner, it must have occurred either at the exact randomly predetermined winning time as determined by Administrator, or if no Game play has occurred at the exact randomly predetermined winning time, then it must be the Game play that occurred at the closest time immediately following the randomly predetermined winning time. Limit one (1) Instant Win play per person per each 24-hour period that the Instant Win is active. More than the specified number of Game plays from any person or e-mail address will void all Game plays from that person or e-mail address. Use of computer programs and other automatic means to play Game is prohibited. Instant Win Game plays generated by script or bot are not eligible. All Instant Win Game plays must be received within 24-hours from the date and time the Instant Win is featured on the Website for the chance to win that week's Instant Win Prize. All Game plays must be made by 9:59 a.m. ET on 1/1/2012, for the chance to win the final daily Instant Win Prize.
7. VERIFICATION: All Instant Winners are subject to verification of eligibility. If, due to a technical error of any kind, more participants are deemed to be Instant Winners, or more Instant Win Prizes are claimed than are intended to be awarded, the intended number of Instant Win Prizes will be awarded in a random drawing from among all verified prize claims received. In no event will Sponsor be obligated to award more than the stated number of prizes. Use of automated Game play devices or programs is prohibited.
8. SWEEPSTAKES RANDOM DRAWINGS: On or about each of the following dates: 2/4/2011; 3/5/2011; 4/5/2011; 5/5/2011; 6/5/2011; 7/5/2011, 8/5/2011, 9/5/2011, 10/5/2011, 11/5/2011, 12/5/2011 and 1/5/2012 one (1) Grand Prize winner will be selected in a random drawing from among all eligible entries received the month prior. Drawings will be conducted by Administrator, an independent judging organization whose decisions are final. Odds of winning a Sweepstakes prize are dependent upon the number of eligible entries received during each month of the Promotion Period. The Sponsor will attempt to notify the potential Grand Prize winners via email within five (5) days of each drawing. If a potential Grand Prize winner cannot be contacted within five (5) days after the first attempt to contact him/her, the Sponsor may select an alternate potential winner in his/her place at random from the remaining eligible entries.
9. REQUIREMENTS OF GRAND PRIZE WINNERS: A potential Grand Prize winner will be required to verify his/her mailing address within five (5) days of being notified. If a potential winner fails to verify his/her mailing address notification form within the required time period, he/she will be disqualified and an alternate entrant may be selected in his/her place in a random drawing of all eligible entries received.
10. PRIZES AND APPROXIMATE RETAIL VALUES (the "ARV"):
a. SWEEPSTAKES GRAND PRIZES AND ARV- (6 total - one per month) - A Flip UltraHD (ARV $200 each; The approximate retail value of all Grand Prizes is $1,200. INSTANT WIN PRIZE AND ARV: Instant Win Prize (25 total, 1 per week) - A pair of movie tickets redeemable at participating movie theatres. Movie tickets are subject to restrictions and expiration dates may apply and are not redeemable for cash (ARV $25 per prize) The Approximate retail value of all Instant Win prizes is $675; APPROXIMATE ODDS OF WINNING AN INSTANT WIN PRIZE DEPEND ON THE TIME OF GAME PLAY AND THE NUMBER OF GAME PLAYS, WHICH IS APPROXIMATELY 100,000.
b. The total ARV for all prizes is $1,875.Any prize details not specified above will be determined by the Sponsor in its sole discretion. Prizes are not transferable or refundable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize (or component thereof) with another prize (or component thereof) of equal or greater value if the prize is not available for any reason as determined by the Sponsor in its sole discretion. The winner is responsible for any and all other costs and expenses not listed above. Prizes may be reported as income to a winner and the winner will be responsible for all taxes associated with the receipt of a prize.
11. PRIVACY AND PUBLICITY: All information submitted by entrants in the Promotion will be treated according to Sponsors' respective Privacy Policies, available at www.sprint.com/privacy and http://about.aol.com/aolnetwork/aol_pp. Except where prohibited, participation in the Promotion constitutes an entrant's consent to the Sponsors' use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
12. GENERAL CONDITIONS: In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes/Instant Win to address the impairment and then resume the Sweepstakes/Instant Win in a manner that best conforms to the spirit of these Official Rules or (b) award the Sweepstakes prizes at random from among the eligible entries received up to the time of the impairment or award all Instant Win prizes claimed prior to the time of impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry/Instant Win play, the authorized account holder of the e-mail address used to enter/play will be deemed to be the participant. Normal Internet access and usage charges imposed by your online service provider will apply. All entries/Game plays will be declared made by the authorized account holder of the e-mail address submitted at the time of entry/Game play. The "authorized account holder" is the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
13.RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Promotion, entrants agree to release and hold harmless the Sponsor, its parent, officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an entrant from submitting an entry; (b) unauthorized human intervention in the Sweepstakes; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
14. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Commonwealth of Virginia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
