Game Marathon Official Rules

NO PURCHASE NECESSARY. OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA, 13 OR OVER. INTERNET ACCESS REQUIRED.

1. Sweepstakes Period: The AOL® Games Sweepstakes begins at 12:00 a.m. (Midnight) Eastern Time ("ET") on December 1, 2009 and ends at 11:59 p.m. ET on December 7, 2009 (the "Sweepstakes Period").

2. How To Enter the Sweepstakes: During the Sweepstakes Period, visit http://www.games.com/play-and-win and play the featured game (the "Game") using your AOL or AIM Screen Name. You must be logged in with your AOL or AIM Screen Name to be eligible for the sweepstakes. Launch and play the Game to receive one (1) entry into the Sweepstakes. You will receive one (1) additional entry into the Sweepstakes each day that you play the Game for a maximum of seven (7) entries during the Sweepstakes Period (a day is defined as 12:00 a.m. ET (midnight) to 11:59 p.m. ET). Normal Internet access and usage charges imposed by your on-line service will apply. Automated Game plays, or those generated by script or bot are not eligible. All Game plays must be complete to be eligible. Any individual whose screen name is on suspension at any time during the Sweepstakes Period, as a result of a Terms of Service violation, is not eligible to participate in the Contest.

3. Eligibility: Open to legal residents of the 50 United States and the District of Columbia, 13 years of age and older as of date of entry. Employees of AOL LLC (the "Sponsor"), Don Jagoda Associates, Inc. (the "Administrator"), their respective affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies (the "Sweepstakes Entities") and their immediate family members and/or those living in the same household of each are not eligible to participate or win. Void where prohibited and subject to all federal, state and local laws.

4. Grand Prize And Random Drawing: One Grand Prize winner will receive $2,000, awarded in the form of a check. The drawing for the will be held on or about December 14, 2009, from among all eligible entries received during the Sweepstakes Period. The Administrator, an independent judging organization whose decisions will be final and binding in all matters related to this Sweepstakes, will randomly select the potential Grand Prize winner. The entrant selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.

5. General Rules: The Potential Grand Prize winner will be notified by mail, e-mail and/or phone. Potential Grand Prize Winner will be required to sign and return an Affidavit of Eligibility, liability/publicity release (except where prohibited by law) within seven (7) days of notification attempt or prize will be forfeited and alternate winner may be selected. If Potential Grand Prize Winner is a minor in his or her state of residence, his or her parent or legal guardian must execute and return the affidavit of eligibility and liability/publicity release (where legal). Income and other taxes, if any, related to the prize are the Grand Prize Winner's sole responsibility (or the parent/guardian if Grand Prize Winner is a minor in his/her state of residence). Return of prize notification as undeliverable may result in disqualification and alternate winner selection. Acceptance of prize constitutes permission to use Grand Prize Winner's name and likeness for trade/promotional purposes without further compensation except where prohibited by law. By entering, entrant (and his/her parents or legal guardians, if entrant is a minor in his/her state of residence) accepts and agrees to be bound by these Official Rules and the judges' decisions. Entries will be declared to be made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, Online Service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website; violates these Official Rules; acts in an unsportsmanlike or disruptive manner: or acts with intent to annoy, abuse, threaten or harass any other person. Entries generated by script or bot are not eligible. Sweepstakes Entities are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in the Sweepstakes which may limit the ability to participate, or by any human error which may occur in the processing and administration of the Sweepstakes. Sponsor reserves the right to suspend, cancel, terminate or modify the Sweepstakes if it cannot be completed as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or corruption of any sort. In such event, Sponsor will award prize from eligible entries received prior to cancellation. As a condition of entering the Sweepstakes, entrant (or parent/legal guardian if participant is a minor) agrees that: 1) under no circumstance will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with the Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees.

6. RELEASES: Grand Prize Winner, by accepting the prize and all entrants, as a condition of entry into the Sweepstakes, agree, as applicable, to release and hold harmless the Sweepstakes Entities, their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies and their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of the Sweepstakes, from and against any and all liability, claims or actions of any kind whatsoever, for injuries, death, damages, or losses to persons or property which may be sustained in connection with submitting an entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use of prize awarded, or participating in any prize-related activity or for any typographical or other error in these Official Rules or the announcement of offering of the prize.

7. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Commonwealth of Virginia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.

8. Winner: For the name of the Grand Prize Winner, available after January 25, 2010, send a stamped, self-addressed envelope by February 25, 2010, to: The AOL Games Sweepstakes Winner F, 100 Marcus Drive (Dept EW), Melville, NY 11775.
